Since June 1, 2014, same-sex marriage has been legal throughout Illinois. If you have the right to get married, you have the right to dissolve your marriage as well. Same-sex marriages follow all of the same rules as any other marriage and dissolution of marriage. One of the emerging areas that is being addressed is the area of parenting time and responsibility when a divorce occurs. Just as in any situation dealing with children, it is ideal if the parents can reach an amicable agreement. This issue becomes extremely difficult when one of the partners in a relationship is not the child’s legal parent. It is extremely important for the non-biological parent in a same-sex marriage to legally adopt the couple’s child to avoid difficulties when trying to establish a parenting agreement after a breakup or divorce.
